Environmental Planning and Utilization | Hukum Positif Indonesia

Indonesian Positive Law-

Environmental planning and utilization are regulated in the provisions of Article 5 – Article 12 of Law Number 32 of 2009 concerning Environmental Protection and Management.

In this description it is stated regarding:

Environmental Planning

Environmental planning is an early part of environmental protection and management activities. Environmental protection and management planning is carried out in several stages, namely:

  1. Environmental Inventory.
  2. Designation of the territory of the ecoregion.
  3. Preparation of Environmental Protection and Management Plan (RPPLH).

Environmental Inventory

This environmental inventory includes the national level, the island/archipelago level and the ecoregion area level. This environmental inventory aims to obtain data and information on natural resources which include:

  1. Potential and availability.
  2. The kind that is taken advantage of.
  3. Forms of mastery.
  4. Management knowledge.
  5. Conflicts and causes arising from management.

Ecoregion Designation

An ecoregion is a geographical area that has similar features of climate, soil, water, native flora and fauna, as well as patterns of human interaction with nature that describe the integrity of natural systems and the environment. Based on the environmental inventory of the minister and related agencies conducting and determining the ecoregion area, taking into account the similarities:

  1. Characteristics of the landscape.
  2. Watershed.
  3. Climate, flora and fauna, socio-cultural, economic, institutional society.
  4. The results of the environmental inventory.

The Environmental Protection and Management Plan (RPPLH) is a written plan that contains potential potential, environmental problems, and efforts to protect and manage them within a certain period of time. The Environmental Protection and Management Plan (RPPLH) consists of:

  1. National Environmental Protection and Management Plan (RPPLH).
  2. Provincial Environmental Protection and Management Plan (RPPLH).
  3. Environmental Protection and Management Plan (RPPLH) of the district/city.

After the existence of a national Environmental Protection and Management Plan (RPPLH) which is regulated by government regulations, then the provinces and regencies/cities with reference to the national RPPLH, also make a provincial Environmental Protection and Management Plan (RPPLH) and an Environmental Protection and Management Plan (RPPLH) of city districts based on an island/archipelago level inventory and an ecoregion level inventory, where between the Protection Plan and  Environmental Management (RPPLH) both nationally, provincially and district cities are interrelated.

Preparation of Environmental Protection and Management Plan

The Environmental Protection and Management Plan (RPPLH) contains plans regarding the following matters (Article 10 paragraph (4) of Law No. 32 of 2009):

  1. Utilization and/or backup of natural resources.
  2. Maintenance and protection of environmental quality and/or function.
  3. Control, monitoring and utilization and preservation of natural resources.
  4. Adaptation and mitigation to climate change.

Environmental Utilization

The utilization of natural resources is carried out based on the Environmental Protection and Management Plan (RPPLH).

If the Environmental Protection and Management Plan (RPPLH) has not been prepared, then utilization is carried out based on the carrying capacity and carrying capacity of the environment by taking into account the following:

  1. Sustainability of environmental processes and functions.
  2. Sustainability of environmental productivity.
  3. Safety, quality of life, and welfare of the community.

In accordance with the level, the carrying capacity and capacity and ecoregion are determined by the minister for the national level, the governor for the provincial level, the regent/mayor for the district/city level. -RenTo201222-
